                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHEAST FROM EAST 40TH STREET,
                   NORTHEAST OF CLIO AVENUE, MORE PARTICULARLY
                   DESCRIBED HEREIN.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located southeast from East 40th Street, 

         northeast of Clio Avenue, more particularly described herein, 
and
         as shown on plat attached hereto and made a part hereof by 
refer-
         ence:
               
                A 10 foot wide unopened alleyway beginning on the
                southwest line of East 40th Street 120.52 feet
                northwest of the intersection of the southwest line
                of East 40th Street with the northwest line of 5th
                Avenue, thence southeast 219.93 feet to the
                northwest line of 5th Avenue, thence southwest
                18.26 feet with 5th Avenue, thence northwest 241.71
                feet to the southwest line of East 40th Street,
                thence southeast 11.95 feet with East 40th Street
                to the point of beginning.  Said alleyway separates
                Lots 1-5 and part of 6 from Lots 9 and 10,
                subdivision of Block 155, East End Land Company's
                Addition No. 1, as shown by plat of record in Plat
                Book 6, Page 71, R.O.H.C.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
